South Dakota
What South Dakota's rule says
What are the calling hours in South Dakota?
In South Dakota, unsolicited consumer telemarketing calls and texts to a residence are allowed only from 9 a.m. to 9 p.m., and never on Sunday (SDCL § 37-30A-3(2)). Autodialed solicitations are allowed only on weekdays, 9 a.m. to 9 p.m. (SDCL § 37-30-28).
South Dakota has two windows: live calls and texts may go out Monday through Saturday, but autodialed solicitations stop at the weekend.
The law names texts ('call or text'), so marketing texts are held to the same 9 a.m.–9 p.m., no-Sunday window.
The state is split between Central time east of the Missouri River and Mountain time in West River, including Rapid City; area code 605 covers both.
The last amendment (2020, HB 1131) is when we can confirm the wording; we couldn't confirm whether the 9-to-9 and Sunday wording predates it.
Who the rule covers
South Dakota's window applies on top of the federal 8 a.m.–9 p.m. rules; where both apply, follow the narrower one.
- Covers: telemarketers sending unsolicited consumer calls or texts to a residence about personal, family or household goods. The definition of 'telemarketer' (§ 37-30A-1(4)) is unusually narrow.
- Not covered: calls at the consumer's express request, about an existing debt, to existing customers, newspapers, and appointment-setting for licensed insurance producers.
South Dakota's rules and where they come from
Telemarketing calls and texts (SDCL § 37-30A-3(2)): No unsolicited consumer telemarketing call or text to a residence before 9 a.m., after 9 p.m., or on Sunday.
Automatic dialing (SDCL § 37-30-28): Autodialed solicitations only on weekdays, between 9 a.m. and 9 p.m. Business-to-business calls are excluded (§ 37-30-24).

Do South Dakota's calling hours apply to texts?
South Dakota's telemarketing law says 'call or text', so marketing texts get the same window: 9 a.m.–9 p.m., never on Sunday.
Time zones and area codes in South Dakota
South Dakota has 2 time zones, so check which one the lead is in: Central (Eastern South Dakota (Sioux Falls)); Mountain (West River (Rapid City)).
Area codes in South Dakota: 605. A number's area code is a clue to where the person is, not proof: people keep their numbers when they move.
Calling South Dakota from TopReach
TopReach smart lists only dial a lead inside the legal window in their own time zone (weekdays 9 a.m.–9 p.m., weekends 10 a.m.–6 p.m.) and skip statutory holidays, and a rep calling a lead outside their hours is asked to confirm first. They don't apply South Dakota's own rule for you. To stay inside it, set your workspace's quiet hours from 9 p.m. to 9 a.m., business days Monday to Saturday.
Recording calls into South Dakota: One-party consent: you can record a call you're on. TopReach records only when your workspace policy says so (never, always, or the rep's choice), and it doesn't play a recording announcement for you, so reps say it at the start of the call where consent is needed.
