What Rhode Island's rule says

What are the calling hours in Rhode Island?

Rhode Island has the narrowest weekday window of any state: unsolicited telephonic sales calls only from 9 a.m. to 6 p.m. Monday through Friday and 10 a.m. to 5 p.m. on Saturday, never on Sunday, and not on state or federal holidays. The rule is R.I. Gen. Laws § 5-61-3.6.

A weekday evening call at 6:30 p.m., legal almost everywhere else, breaks Rhode Island law.

Rhode Island's holidays include two days no other state observes: Rhode Island Independence Day on May 4 and Victory Day on the second Monday in August. In general-election years, Election Day is a state holiday too (R.I. Gen. Laws § 25-1-1).

The holiday ban covers state or federal holidays falling Monday through Friday; the statute doesn't say what happens when a holiday lands on a Saturday.

There's no business-to-business exemption in the definitions, though the act exempts many regulated sellers.

Who the rule covers

Rhode Island's window applies on top of the federal 8 a.m.–9 p.m. rules; where both apply, follow the narrower one.

  • Covers: telephonic sellers and salespersons making unsolicited sales calls to residential, mobile or pager numbers.
  • Not covered: calls to prior purchasers and many regulated sellers listed in § 5-61-2, including banks, insurers, securities and real estate licensees, utilities and cable companies.

Calling Rhode Island from TopReach

TopReach smart lists only dial a lead inside the legal window in their own time zone (weekdays 9 a.m.–9 p.m., weekends 10 a.m.–6 p.m.) and skip statutory holidays, and a rep calling a lead outside their hours is asked to confirm first. They don't apply Rhode Island's own rule for you. To stay inside it, set your workspace's quiet hours from 6 p.m. to 9 a.m., business days Monday to Saturday, and keep Saturday calls to 10 a.m. – 5 p.m., and skip Rhode Island's state holidays that aren't federal holidays, such as Victory Day and May 4.

Recording calls into Rhode Island: One-party consent: you can record a call you're on. TopReach records only when your workspace policy says so (never, always, or the rep's choice), and it doesn't play a recording announcement for you, so reps say it at the start of the call where consent is needed.
